The terms of registration and use below apply to the relationship between the user, on the one hand, and BIDUM, on the other hand, when using the website. We ask users to read these conditions of registration and use thoroughly before using the website. BIDUM may modify these conditions of registration and use at any time. Any use of the user account, for example by logging on to the website after publication of the amended registration and conditions of use, constitutes acceptance of these new registration and conditions of use. Further use of the website by the user, such as participation in online auctions, conclusion of purchase agreements, payment and transfer of parcels/goods, is subject to the general terms and conditions of the BIDUM Partner.

Users cannot in any way derive any rights from the website or its contents. No information or content on the website may be used, copied or published for non-private or commercial purposes, except with the express prior consent of BIDUM or the respective holders of intellectual property rights.

In the event of any discrepancy and/or lack of clarity between the conditions for registration and use in English and the conditions for registration and use in other languages, the English version shall prevail.

If one or more of the provisions or part of the provisions of these registrations and conditions of use are to be declared null or void, the validity of the other provisions shall not be affected by this nullity. The parties shall immediately and in good faith negotiate a valid provision to replace the null/void provision, which corresponds as far as possible to the purpose of the null/void provision.

The user accepts the present conditions of registration and use when registering his/her user account on the website. 3.2 In order to create a user account, the user must provide certain (personal) data, such as his/her I name; (ii) email address; (iii) gender; (iv) address (country, street, postal code, city); (v) language; (vi) mobile phone number; and (v) capacity (natural person/company). Subsequently, the user chooses his/her own password for his/her personal user account and for each auction registration.

The user guarantees the accuracy and completeness of the (personal) data provided and undertakes to keep the data up to date and to correct it in the event of any change. The user also undertakes to keep his/her password confidential and not to transfer his/her user account.

BIDUM reserves the right, at any time and without giving reasons, to refuse or terminate the registration of a user account.

The user accepts that BIDUM shall use (personal) data for the management and optimisation of the website and that BIDUM shall transmit such data to the relevant BIDUM Partner(s) who shall use such data in accordance with the general conditions and the applicable special conditions.

BIDUM is solely responsible for managing the website. All other services provided through or in addition to the website, such as the organisation and execution of online auctions, private sale, payment and transfer of goods, are entirely the responsibility of the seller or BIDUM Partner, as stipulated in the general terms and conditions applicable.

All information on this website is for information purposes only. The website and its contents are intended to provide an overview of the services of the BIDUM Partner(s) and the lots/goods offered. Although BIDUM wishes to keep the information on the website up to date and accurate, some information may be incomplete or incorrect. Buyers or bidders are always considered to have carefully inspected the lots and/or goods at the time of viewing provided for that purpose, and thus to have known and accepted the characteristics, including any visible and/or reported defects, prior to bidding. Information on the goods on the website/The lots offered and the descriptions of the auctions/sales shall be provided and managed by the seller and/or BIDUM Partner. BIDUM cannot be held liable for any damage that occurs or may arise as a result of incomplete or incorrect information on the website.

BIDUM shall not be liable for any invitation to tender or sale of lots/goods during an online auction or private sale in which the user participates. All online auctions and private sales are the sole responsibility of the seller, as stipulated in the general terms and conditions in force. BIDUM shall be solely responsible for the management of the website and BIDUM shall never be involved in any aspect of the online auction in the event of a dispute.

When visiting or registering on the website, BIDUM is not liable for any technical problems.

BIDUM and the BIDUM Partner are not liable in the event that, due to technical deficiencies, bidding is not possible or the auction and/or private sale is prevented. In that case, the user cannot claim compensation for any direct or indirect damage, including loss of opportunity.

Any websites or sources referred to by hyperlinks on the website are the responsibility of their respective owners or publishers. BIDUM shall not be liable for the content of these sources or websites.

COPPYRIGHT AND OTHER (INTELLECTUAL PROPERTY) The website and its content (including design, text, images, logos, etc.) are protected by copyright. BIDUM is the sole owner of the copyright in the logo. BIDUM, the BIDUM Partner and/or the seller shall be the copyright holder(s) of the texts and information provided on the website.

BIDUM cannot be held liable in any way for any infringement of copyright or other intellectual property rights or for any other legal or regulatory infringement relating to goods or lots shown, offered or sold on the website. The seller shall always be responsible for the legality of its actions and the products or lots for which the seller has instructed BIDUM Partner to offer and/or auction. As a result, the seller guarantees that his goods or lots comply with the applicable legislation, that he is the legal holder of the intellectual property rights associated with them and that such goods or lots do not infringe the rights of third parties.

Users shall, in the cases referred to above, only address themselves to the seller concerned and shall not hold BIDUM and the BIDUM Partner(s) liable in any way whatsoever or involve them in any proceedings.

They shall inform BIDUM in a timely manner of the existence of a potential infringement or illegality on the website in order to enable BIDUM to investigate it and whether or not to take the necessary measures, such as the removal of infringing content or the cessation of an auction of infringing goods.

COMPETENT COURT AND APPLICABLE LAW 6.1 Registration and conditions of use and legal relations arising therefrom shall be governed by the laws of the Netherlands. In the event of any dispute, it is only the courts of Amsterdam which have jurisdiction, even in the case of a dispute.
